KZN NGO Sector has had enough |

The NGO/NPO Sectors represented by The KZN Provincial Welfare, Social Services and Development Forum and The KZN Network of Directors of Subsidised Welfare Organisations representing all fields of service met today to hear first hand how the NPO Sector in the Free State went to court and won their case against the Dept of Social Development and heard the judge issue a structural order compelling the Free State Department of Social Development to revise its policy on financial awards to NPO’s in the Welfare Sector.
KZN NGO’s are now seriously considering taking similar joint action unless constructive and fair engagement with the DSD is forthcoming.
Dr. Wilem Botha, visiting from the Free State, outlined for the representatives of the NGO sector exactly how best to proceed should legal action be necessary.
The KZN Provincial Dept of Social Development were informed of the NGO’s intention to seek legal advice in a letter dated 9th September 2010.
The major aim of any action taken is to better protect the basic human
rights of the service recipients’ and staff as detailed in the SA
Constitution. Judgement in the Free State noted that ‘the present
situation (in relation to the Financing Policy in particular) violates
the rights of children and vulnerable groups as laid down in the
Constitution and in other legislation such as the Children’s Act and the
Older Person’s Act.’
